JAMESTOWN – The Jamestown man accused of killing his wife and step son in December has been indicted on two counts of first-degree manslaughter.
Jamestown police say a Chautauqua County Grand Jury indicted 53 year-old Allen Witruke on the charges Monday morning.
Witruke is accused of killing 52-year-old Catherine Witruke and 34-year-old Eric Washburn on December 7. He allegedly used blunt force trauma on one of the victims and stabbed both victims multiple times. The bodies of the two were discovered the following morning at 235 Barrows St., where Witruke and the two victims had lived. He was taken into custody by police in Olean the same day.
Witruke had originally been arraigned on two counts of 2nd degree murder. But According to the Jamestown Post-Journal, acting county district attorney Patrick Swanson said an evaluation by both the DA’s office and public defender determined that the two counts of manslaughter was more fitting.
Witruke remains in the county jail on $1 million cash bail. The Post-Journal is reporting that his next court appearance will be a pre-motion conference is scheduled for July 11.
