ALBANY – New York’s vaping industry says it will pursue legal action to stop a statewide ban on flavored e-cigarette sales from taking effect.
The New York State Vapor Association said Monday it is interviewing law firms and considering its options in response to Gov. Andrew Cuomo’s announcement one day earlier that the state would be taking “emergency executive action” this week to halt sales of the nicotine-based products amid a spate of serious respiratory illnesses and rising rates of use among youth.
Vape shops around the state say flavors make up 90 percent of their sales, and warn that a ban would force them to lay off employees and shutter their businesses.
The ban would apply to all flavors except tobacco and menthol.
