JAMESTOWN – A lawsuit filed against the state’s effort to restrict and regulate firearms was denied Wednesday in State Supreme Court in Albany County. State Supreme Court Justice Thomas McNamara denied a request for an injunction to temporarily stop the NY SAFE Act, a controversial new gun control law passed in a dead-of-night legislative session in January.
The suit was filed by Bob Schulz – a longtime activist who is not a lawyer but represented himself in court. He had sought an injunction against the law on grounds that the Message of Necessity used by Gov. Andrew Cuomo, which circumvented the usual three-day waiting period before lawmakers vote on a measure, was misapplied. Justice McNamara cited the long-standing precedent against the courts getting involved in legislative matters as the reason for denying the injunction request.
Upon hearing that his request for an injunction was denied, Schulz said he plans to appeal the decision. Other cases are also still pending.
