ROCHESTER – There is still no decision from the New York Supreme Court Appellate Division in Rochester on the annexation of the Jamestown Board of Public Utilities Dow Street substation property, located in Falconer near the border with the city of Jamestown.
On Friday, the 4th Appellate District released its latest group of appeal decisions. However, the court did not release a verdict on the annexation case between the city and the Town of Ellicott/Village of Falconer.
In the summer of 2017 Jamestown moved to annex the substation property from the town of Ellicott and Falconer and both filed a petition opposing the effort. That meant the case has to be settled in state appellate court.
Both sides appeared before the appellate court justices in Rochester on April 10. Since then, they have been awaiting a decision.
According to the court’s website the next proposed release date for decisions is Friday, June 28.
