MAYVILLE – The Cheektowaga man who was found not guilty of attempting to take the life of a Chautauqua County Sheriff Deputy will still be serving time in prison.
According to the Post-Journal, Chautauqua County Court Judge David Foley on Monday sentenced Justin Haffa to an indeterminate sentence of 28 months to 7 years in state prison. The sentence is the maximum allowed under state law. The public defenders office had requested probation.
Haffa was convicted earlier this year of third-degree robbery following the Sept. 11, 2016 incident in which he crashed his car along Route 60 in the town of Pomfret and then fought with Chautauqua County Sheriff Deputy Sara Cunningham as she was giving him a field sobriety test. He ended up taking her gun before fleeing the scene.
Haffa faced several charges – including attempted murder – when he was brought to trial. His first trial was declared a mistrial because of a botched presentation of evidence by the District Attorney’s office. The second trial resulted in his being found not guilty on all counts except for the robbery charge.
