MAYVILLE – The Dunkirk Woman who was found not guilty of murdering her boyfriend last summer will still have to spend time in prison on an illegal weapon possession charge.
Chautauqua County District Attorney Patrick Swanson said 29-year-old Rebecca Ruiz was sentenced Tuesday in County Court to a 6 years in state for second-degree criminal possession of a weapon.
The charge is considered a Class-C violent felony and carries a minimum sentence of 3.5 years and a maximum of 15 years.
Ruiz’s trial concluded in March after she was tried in the shooting death of Julian Duman. The incident took place on July 6 at 141 Lake Shore Drive East in the city. She was first charged with second-degree murder but the jury found her not guilty after she claimed it was a mistaken identity and she thought Duman was actually an abusive ex boyfriend. During the investigation it was illegally in possession of the gun used.
Her legal team plans to appeal the illegal weapon conviction.
