ALBANY – Governor Andrew Cuomo is no longer trying to get his Democratic primary opponents kicked off the ballot.
In recent weeks, Cuomo’s campaign has been trying to remove Fordham University Law School professor Zephyr Teachout from the democratic primary ballot by claiming she did not meet the state’s residency requirement to run for Governor.
But on Wednesday, a State Appellate Court in Brooklyn rejected his campaign’s argument. A spokesman for the Cuomo campaign said it would not appeal the decision.
The primary will take place on September 5.
