ELLERY – A Jamestown firefighter arrested for allegedly growing marijuana last fall on an Ellery property has been conditionally discharged for a year.
The Post-Journal says 58 year-old James Gatto pleaded guilty to fourth-degree criminal possession of marijuana, a class A misdemeanor, in January.
The charge stems from Oct. 26, when members of the Southern Tier Regional Drug Task Force reportedly discovered Gatto growing marijuana on a property off of Bemus Ellery Road.
Police said the amount of marijuana seized met the threshold to constitute a felony charge.
Gatto is a lieutenant and 29-year member of the Jamestown Fire Department and was placed on administrative leave pending court proceedings.
