GERRY – The Cattaraugus County man who was behind the wheel during a fatal automobile crash last week in the town of Gerry is now facing charges.
The Chautauqua County Sheriff’s Office says 41-year-old James Newell of Steamburg has been charged with unauthorized use of a motor vehicle, reckless driving, unsafe passing, failure to keep right and speed not reasonable and prudent.
Newell was the driver in the vehicle that crashed last Friday, Feb. 15 around 11:30 a.m. on Gerry-Ellington Road in Gerry.
His 43-year-old brother, Paul Newell, died as a result of the crash.
Newell is scheduled to appear in Gerry Town Court at a later date.
